In light of the EEOC, NLRB, etc. “activity” in 2012, “What is still safe to ask in the hiring process?” “When and how should you ask it?” “Can you still terminate employees for social media and other activities they engage in ‘off the clock?’” “How long past FMLA leave do you need to allow someone to stay out on a leave of absence before terminating them?” “How long do you need to provide light duty once it’s clear the employee is never going to be able to return to his/her regular job?”
